EU Remedies Directive 2009

The Remedies Directive came into effect for all Member States on 20th December 2009. The Directive widens the legal remedies available for the award of public contracts for any breaches of the public procurement rules. It applies prospectively to future adverts, expressions of interest, contracts and frameworks.

The three main elements are:

  • it strengthens review procedures
  • harmonises standstill period across Member States, taking into account different forms of communication
  • new remedies eg ineffectiveness for the most serious rule breaches.
